The Duffy Firm Secures $45 Million Verdict Against Temple University Hospital

PHILADELPHIA, Aug. 6, 2024 ~ Philadelphia, PA - The Duffy Firm, a renowned catastrophic injury law firm in Philadelphia, has recently achieved a monumental victory against Temple University Hospital. The firm secured a staggering $44,894,877.70 verdict on behalf of their client, 19-year-old Dylan Hernandez, who suffered life-altering injuries due to the hospital's negligence.

The case, titled Dylan Hernandez v. Temple University Hospital, Inc. et al, was represented by Tom Duffy and Sean Dougherty from The Duffy Firm. Hernandez was an innocent bystander who was shot in the neck on July 22, 2020. He was immediately taken to Episcopal Hospital and intubated before being transferred to Temple University Hospital's SICU floor.

Upon arrival at the hospital, Hernandez was diagnosed with a left vertebral artery injury, a broken jaw, and a fracture of his spine at C2. Two days later, he was moved to a regular floor where he underwent a barium swallow test conducted by a speech therapist. The results showed that he had moderate pharyngeal dysphagia and a high risk of aspiration while eating or drinking.

Despite these findings, only two consistencies were tested - liquids and purees - and no further evaluations or observations were made before Hernandez's discharge. The instructions given to him upon discharge were drafted by a third-year resident and failed to include crucial recommendations from the speech therapist.

Less than 48 hours after being discharged from the hospital, Hernandez aspirated while eating mashed potatoes and suffered cardiac arrest. This resulted in hypoxic respiratory failure and neurologic injury.

Tom Duffy stated that "Defense counsel Joe Tucker and Rebecca Waddell are certainly formidable adversaries, backed by two very large law firms. They threw everything they could at us." However, for Duffy and Dougherty, this case was about seeking justice for their client who will now require lifelong care due to the hospital's negligence.

Prior to the trial, the plaintiff had demanded $32,000,000 while the defense offered only $500,000. With delay damages, the final amount awarded is expected to be just under $52,000,000.
